Supreme Court Declines to Hear Hidden-City Arguments
In refusing to hear airlines’ arguments, the court opens the door for passengers to pursue anti-trust suit against Delta and Northwest.
by LISA MATTE A U.S. SUPREME COURT RULING HAS CLEARED THE WAY FOR A GROUP OF PASSENGERS TO COLLECTIVELY PROCEED WITH AN ANTI-TRUST SUIT CLAIMING DELATA AIR LINES AND NORTHWEST AIRLINES UNLAWFULLY BANNED HIDDEN-CTIY TICKETING. Justices last week declined to hear the airlines’ argument claiming passengers should only be allowed to sue individually. Long discouraged by most major airlines, hidden-city ticketing is a practice that allows passengers to secure lower fares by purchasing tickets to final destinations that include a stop at an intermediate destination. Passengers then disembark at the intermediate destination. The strategy works when the fare for travel to the final destination is less expensive than the fare for travel to the intermediate destination.
